Welcome to Afraeka Adventures Ltd (“Company,” “we,” “our,” or “us”). These Terms and Conditions govern your use of our website (https://afraekaadventures.com) and the booking of any tour, safari, or travel service operated by us. By accessing our website or placing a booking inquiry, you agree to comply with and be bound by these terms.
Please read them carefully before making any financial commitments.
1. Booking Agreement Under Our Terms and Conditions
- A booking is considered initialized once a formal inquiry or reservation form is submitted via our platform.
- A legally binding contract between Afraeka Adventures Ltd and the client is only established when we issue a formal booking confirmation invoice following the receipt of the required deposit.
- The person making the booking guarantees that they have the authority to accept, and do accept on behalf of their travel group, the terms of these conditions.
2. Time-Sensitive Permits (Gorilla and Primate Trekking)
- Permit Availability: Mountain gorilla trekking, chimpanzee trekking, and specific national park permits are under the strict, direct jurisdiction of local wildlife authorities (such as the Uganda Wildlife Authority). Availability is subject to real-time verification and changes rapidly.
- Non-Refundable Policy: Due to the strict reservation policies of wildlife governing bodies, all primate tracking permit fees are 100% non-refundable and non-transferable once purchased by us on your behalf.
- Permit Fees: Permit costs must be paid in full upfront alongside your initial deposit to guarantee reservation.
3. Payment Schedule
To secure accommodations, transport, and logistical tracking assets, the following payment timelines must be adhered to:
- Deposit: A deposit of 30% to 50% of the total safari package price (plus 100% of any required primate trekking permits) is required at the time of booking confirmation.
- Final Balance: The remaining balance must be paid no later than 45 days prior to the safari departure date, unless specified otherwise in writing by our team.
- Late Payments: Failure to pay the final balance by the designated due date may result in the cancellation of your safari and forfeiture of your deposit under these Terms and Conditions.
4. Cancellation Policies and Terms and Conditions
Should you or any member of your traveling group need to cancel a confirmed safari, the cancellation request must be submitted to us in writing via email. The following cancellation fees apply based on when the written notice is received relative to your departure date:
- 60+ days prior to departure: Forfeiture of the initial deposit plus the full cost of trekking permits.
- 45 to 59 days prior to departure: 50% of the total safari package cost is charged as a cancellation fee.
- Less than 45 days prior to departure: 100% of the total safari package cost is charged as a cancellation fee (no refund).
5. Changes and Alternations
- By the Client: If you wish to make changes to your confirmed itinerary, we will make every reasonable effort to accommodate them, subject to availability. Any costs incurred from these adjustments (such as hotel modification fees) will be charged to the client.
- By the Company: While we plan itineraries meticulously, unforeseen local conditions (such as road washouts, weather patterns, or lodge closures) may require us to alter routes, accommodations, or activities. We reserve the right to substitute comparable alternatives without prior notice.
6. Client Responsibilities and Travel Documents
- Passports & Visas: Travelers must hold a valid passport with at least 6 months of validity remaining from the date of entry into East Africa. It is the sole responsibility of the client to secure relevant entry visas (such as the East Africa Tourist Visa).
- Medical Requirements: Clients are responsible for ensuring they meet all health and immunization criteria (including Yellow Fever vaccinations and malaria prophylactics where applicable). You must inform us of any severe physical limitations, allergies, or medical conditions prior to booking.
7. Comprehensive Travel Insurance
- It is a mandatory booking requirement of these Terms and Conditions that all travelers obtain comprehensive international travel insurance before departing with Afraeka Adventures Ltd.
- Your insurance policy must explicitly cover personal injury, medical expenses, emergency medical evacuation, repatriation, trip cancellations, and loss of personal baggage or effects.
8. Limitation of Liability and Force Majeure
- Afraeka Adventures Ltd acts as an agent arranging accommodations, local flights, transport, and activities through third-party operators. While we vet our partners thoroughly, we cannot be held responsible for any injury, damage, loss, delay, or irregularity caused by these independent third-party entities.
- Force Majeure: We cannot accept liability or pay compensation where the performance of our contractual obligations is prevented or affected by events amounting to “Force Majeure” (unforeseen circumstances beyond our control). This includes, but is not limited to: war, civil strife, natural disasters, extreme weather conditions, government restrictions, border closures, or technical transport disruptions. While we vet our partners thoroughly, we cannot be held responsible for any injury, damage, loss, delay, or irregularity outside the scope of these Terms and Conditions.
9. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Uganda. Any disputes arising directly out of services rendered under these terms shall be subject to the exclusive jurisdiction of the courts of Uganda.
